Cassidy's New York Production "The Rat Pack Is Back!" Stymied by Supper Club Ownership According to NLRB Finding

NEW YORK--(BUSINESS WIRE)--Based on a charge by Actors Equity Association against Edison Associates LLP d/b/a The Supper Club (the Respondent), the finding of the National Labor Relations Board vindicates David Cassidy and his production company and found that they were forced to close the production of "The Rat Pack Is Back!" after previews. In a decision handed down by the NLRB on February 21, 2007, it was concluded that Edison Associates LLP, through its President, Martin Thesing, engaged in unfair labor practices.

"The Rat Pack Is Back!" opened at The Supper Club on November 17, 2005, and ran for only eight performances. Equity's claim in the complaint was that the show's closing was forced "because members of the cast were represented by the Union." It further claimed that the theater "used coercive tactics" against Equity actors in the show, directed by Cassidy and in which he made an appearance as Bobby Darin.

The remedies by the NLRB ordered Edison Associates and its officer, Thesing, to cease and desist from engaging in unfair labor practices. Because "the contract was canceled by force of the Respondent's actions," it was further ordered that the Respondent provide an offer in writing to restore the original contract and the resumption of "The Rat Pack Is Back!" if Cassidy's production company "is willing."

Edison was also ordered to make whole the four actors and one actress in the production as well as the stage manager and two other production employees, remunerating them for loss of income and benefits for a period of time to be determined in compliance proceedings.
